Although we have an excellent safety record, there is an inherent risk of injury in adventure activities. We assume no liability for personal injury or loss of personal belongings. It is your responsibility to get to the pickup location at least 15 minutes before the departure time. You are responsible to load and secure your gear to our vehicle before departure. Please note that ALL inflatable rafts must be deflated prior to loading them. Also note that our drivers are not allowed to be on the deck to load or unload your gear, and you will need to manage that yourself. We will provide straps for securing your gear. No refunds will be issued for missed shuttles.
By making this reservation you agree to the following terms for yourself and all parties booked under this reservation. Please read it carefully.
Participant Release of Liability and Assumption of Risk Agreement
In consideration of being allowed to ride the Coloma Shuttle, I acknowledge, appreciate, and agree that:
- The shuttle runs on a schedule. I am aware that if I do not arrive at least 15 minutes prior to the shuttle departure time, I may not be able to load my gear and utilize the shuttle. I am aware that if I miss the shuttle, a refund will not be issued and I will have to find another ride.
- It is my responsibility to get all my gear to the pick-up location and loaded and secured on the vehicle before the scheduled departure time. I understand that all inflatable craft, including rafts and kayaks, must be deflated in order to be transported on our trailers. Additionally, I understand that shuttle drivers will not climb onto the trailer platforms to assist in loading and securing or unloading my gear.
- I knowingly and freely assume all risks for myself and for all parties included in this booking, both known and unknown, even if arising from the negligence of the releases or others, and assume full responsibility for my participation.
- I willingly agree to comply with the stated and customary terms and conditions for participation. I, for myself and on behalf of my heirs, assign, personal representatives and next of kin, hereby release, indemnify, and hold harmless the Coloma Shuttle, South Fork Arts and Recreation, El Dorado County Air Quality Management their officers, officials, members, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of the premises used for the activity (“Releasees”), with respect to any and all injury, disability, death, or loss or damage to person or property associated with my presence or participation, whether arising from the negligence of the release or otherwise to the fullest extent permitted by law.
I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY BOOKING A SEAT, AND AGREE TO IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
Finally, I hereby irrevocably consent to authorize the Coloma Shuttle and South Fork Arts and Recreation to use and reproduce any and all photographs taken of me for any purpose whatsoever, without further compensation to me.
